Article 1 – These conditions govern GEM ZEN sales of minerals, jewelry and wellness items.

Article 2 – Price

The prices of our products are indicated in euros, all taxes included (VAT and other taxes applicable on the day of the order), unless otherwise indicated and excluding processing and shipping costs.

If you are ordering from a country other than mainland France, you are the importer of the product(s) concerned.

Customs duties or other local taxes, import duties, or state taxes may be payable. These duties and amounts are not the responsibility of "GEM ZEN" and will be your responsibility and are your sole responsibility, both in terms of declarations and payments to the competent authorities and organizations in your country. We advise you to inquire about these aspects with your local authorities. All orders, regardless of their origin, are payable in euros.

GEM ET ZEN reserves the right to modify its prices at any time, but the product will be invoiced on the basis of the price in effect at the time of validation of the order and subject to availability.

The products remain the property of “GEM ZEN” until full payment of the price.

Please note: as soon as you take physical possession of the products ordered, the risks of loss or damage to the products are transferred to you.

Article 3 – Orders Contractual information is presented in French and will be confirmed at the latest at the time of validation of your order.

GEM ZEN reserves the right not to record a payment, and not to confirm an order for any reason whatsoever, and more particularly in the event of a supply problem, or in the event of difficulty concerning the order received.

Article 4 – Validation of your order

Any order placed on the website implies acceptance of these General Conditions.

Any order confirmation implies your full acceptance of these general terms and conditions of sale, without exception or reservation. All data provided and the recorded confirmation will constitute proof of the transaction. You declare that you are fully aware of them. The order confirmation will constitute your signature and acceptance of the transactions carried out.

A summary of your order information and these General Conditions will be sent to you in PDF format via the email address you provided with your order confirmation.

Article 5 – Payment

By confirming your order, you are obligated to pay the indicated price. Payment for your purchases can be made by credit card, check, or bank transfer. Your card will be debited at the time your order is confirmed.
There are multiple payment options on our online store:

• Checks for France only, debit at 30/45 days

Article 6 – Withdrawal

In accordance with the provisions of Article L.121-21 of the French Consumer Code, you have a withdrawal period of 14 days from receipt of your products to exercise your right of withdrawal without having to provide reasons or pay a penalty. Returns must be made in their original condition and complete, unopened and sealed (packaging, accessories, instructions).
In this context, your responsibility is engaged.

Any damage to the product incurred during this process may invalidate your right of withdrawal. You are responsible for the return shipping costs. If you exercise your right of withdrawal, Centre PHI will refund the amounts paid within 14 days of receiving your request and using the same payment method used when placing the order.

EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
In accordance with the provisions of Article L.121-21-8 of the Consumer Code, the right of withdrawal does not apply to: • The provision of services fully performed before the end of the withdrawal period and the performance of which began after the express prior agreement of the consumer and express waiver of his right of withdrawal. •

Article 7- Availability

Our products are offered while they are visible on the site and while stocks last. For products not in stock, our offers are valid subject to availability from our suppliers.

If a product is unavailable after you have placed your order, we will inform you by email.
Your order will be automatically cancelled and no bank debit will be made.

Article 8 – Delivery

• Your packages are carefully packaged in paper and cardboard only!
• They will be sent to you as soon as possible or can be collected directly from the store.
• Shipping between 12 and 72 hours unless you receive a message with a specific date within 48 hours of order confirmation.
• Once the shipment is made, you will receive a tracking number within a few hours for any order over €10.

We are not responsible for delays caused by customs.

In accordance with legal provisions, in the event of a delivery delay of more than 14 days, you have the option of canceling the order under the terms and conditions defined in article L 138-2 of the Consumer Code.

If the customer is absent when the carrier or post office calls, or when the relay point is informed, it is up to the customer to take the necessary steps to collect the packages under the conditions mentioned on the delivery notice.

"GEM ET ZEN" cannot be held responsible for late delivery due exclusively to the unavailability of the customer after several proposed appointments or waiting for collection at the relay point.

Article 9 – Guarantee

We guarantee our products in accordance with current legal provisions, i.e., for 1 full year, with remote assistance, return and exchange if necessary. Satisfaction guaranteed or your money back!

All claims, requests for exchange or refund must be made by email or post within 14 days of delivery.

The products must be returned to us in the condition in which you received them with all sealed elements (accessories, packaging, instructions, etc.).

"In accordance with articles L211-2 and L217-7 of the Consumer Code, lighting and luminaire articles for salt and selenite lamps benefit from a legal guarantee of conformity of 2 years from the date of delivery to the customer."

Shipping costs will be refunded to you based on the invoiced rate and return costs will be refunded to you upon presentation of supporting documents.

Article 10 – Liability

The products offered comply with current French legislation. "l'âme agit du ciel" cannot be held liable for non-compliance with the legislation of the country where the product is delivered. It is your responsibility to check with local authorities regarding the possibilities of importing or using the products or services you plan to order.

Furthermore, "GEM ET ZEN" cannot be held responsible for damages resulting from improper use of the purchased product. Finally, "GEM ET ZEN" cannot be held responsible for any inconvenience or damage inherent in the use of the Internet network, in particular a breakdown in service, an external intrusion or the presence of computer viruses.

Article 11 – Intellectual property

The computerized records of “GEM ET ZEN” will be considered by all parties concerned as proof of communications, orders, payments and transactions between the parties.

Article 14 – Retention of title clause

The products are sold subject to retention of title until full payment of their price.

Article 15 – Applicable law in the event of disputes

The language of this contract is French. These terms of sale are subject to French law. In the event of a dispute, the French courts will have sole jurisdiction.
